born April 11, 1773 in Little Beaver Dam, Cravens County, NC, and died
August 25, 1837 in Conecuh CO, AL (Source: Marsena Hawk Smith Info, Sept.
1999.). He married Sarah "Sally" Stanley February 13, 1794 (Source: Fam
Sheets of Alline W. Kelley, El Dorado, AR.), daughter of Sands Stanley and
Zilphia Edwards.

The WITHERINGTON FAMILY BOOK (by Bill Witherington) indicated that William
was a Justice of the Peace in Conecuh County about 1820. Records of Alline
W. Kelley of El Dorado (a descendant) indicates that Wm Witherington SR.
moved from Dobbs CO, NC to SC during the Revolution. This family moved to LA
about 1809-1812, and then by 1821 to Conecuh County, AL. The two older
girls, Elizabeth Witherington (m. Ezekial Norwood) and Martha Witherington
(m. David Pipes), remained in Feliciana Parish, Louisiana. Elizabeth Norwood
is buried at the Ellis Place Cemetery in Norwood, LA. Martha Pipes is buried
in the Pipes Family Cemetery at Beechwood Plantation, Clinton, LA.

William Witherington served as Justice of the Peace, Conecuh County July 15,
1824. He was one of the earliest residents of Conecuh County. Youngest
daughter (Amanda) is said to have been born August 21, 1821 in Alabama, so
the Witherington Family arrival in Conecuh from Feliciana Parish, LA would
have been before 1821.

SC (NE of SUMTER), pg. 124, as: WILLIAM WITHERINGTON (probably SR.) as
follows: "One male over 45 (WILLIAM, Sr.); one female 10-15 (Daughter); and

One female 26-44 (Elizabeth Lewis).

Wm Witherington, Jr. was married to Sarah "Sally" STANLEY before 1809.

"William Witherington (II) sold his land on Lynches Creek in South Carolina
in 1804 and emigrated to East Feliciana Parish, LA, where he and his family
lived for several years. During that time, the two oldest daughters, Martha
and Elizabeth married and when the family moved to Alabama, the married
daughters remained behind."

William Witherington, Jr. received an Ensign's Commission on July 7, 1813,
granted by the Governor of the Mississippi Territory, David Holmes. He
served during the War of 1812 against the British. It is said that he fought
in the Battle of New Orleans. This would have been during the period that
the family was living in Felicaina Parish, La.

William Witherington, Jr. would have been 60 years of age at the time of
these land acquisitions. His Son, William Sebastian (b. 1810), would have
been only 23 years of age in 1833. These are likely lands acquired by
William Witherington, Jr.

According to Jan 12, 1969 letter from Lela Fletcher Kidwell (Talihina, OK)
to her cousin Betty Grimmett Steel (Tulsa, OK), William Witherington, Jr.
and wife Sarah 'Sally' Stanley Witherington are buried in the original
cemetery located on Witherington land on the Sepulga River in Conecuh
County. This was prior to later families moving to Lyeffion (on higher
ground) to avoid the 'death causing fevers' of the swampy lands on the
Sepulga River.

Notes for Daniel E. Witherington:

FROM THE WITHERINGTON FAMILY BOOK by Bill Witherington, Daniel served as a
Private in the Louisiana State Militia at the Battle of New Orleans in the
War of 1812. He died of a heart attack at the age of 65 in Conecuh County,
AL.


A report from office of Third Auditor, Dept. of the Treasury shows that he
enlisted on Dec. 25, 1814 and served to March 22, 1815 as a private in
Captain Bill's Company of Louisiana Militia. In 1817, his widow, Melissa,
stated he enlisted in East Feliciana Parish and was discharged at New
Orleans. It was not stated that the veteran was wounded. Pension for widow,
Melissa King (Cert # 23,560-Act of March 9, 1878/Knoxville Agency) was
issued May 21, 1879 at the rate of $8 per month.

NAME: Withington, Daniel

RANK: Private

COMPANY: 10 and 20 Cons. Reg't., La. Mil.

Daniel was the first burial at the Witherington Family Cemetery, at the site
that he had selected in Conecuh CO, AL. Gravestone shows that he was a Pvt.
in the War of 1812. On the 1860 Conecuh County census this family is shown
as # 22, Daniel is age 64, born in SC, a farmer, with Real Estate of $1000,
and personal assets of $4610.

NOTE: An early DAR application form indicated his death as Aug. 21, 1860.

Note: (1860 Conecuh, AL Census) Leander Witherington, age 32, born in
Alabama, farmer, appears next door as Fam # 23. This 'could' be an earlier

son of William and Melissa King Witherington. Leander's wife is Eliza, age
24, and children Samuel (2), Nancy (1) and Daniel (1 month).

Died Very Sudden - DANIEL WITHERINGTON died very sudden at his residence in

It has been learned that David Pipes served as Treasurer of the State of
Louisiana, and later served in the State Legislature. Dates are unknown.

Ebenezer Ellis to John and Mary (Ellis) Witherington, one Negro girl named
Lew, about five years old. In presence of James Witherington and William
Witherington. Dated: 1 Feb 1827 by Nathan Hawthorn, JP/ Recorded in my
office in Book Marked "B". page 87 on 2nd Feb. 1827 James Sampey, Clerk; by
W. R. Bohing, Deputy Clerk.

NOTE: Above deed of conveyance was later filed in Calhoun County, AR on 12
July, 1855 by James H. Means, Clerk. Unknown, but it is very likely that the
Negro slave girl, Lew, was still living with the family in Calhoun County in
1855, and Mary Ellis Witherington was re-establishing ownership of the slave
girl in her individual name, following the death of husband John
Witherington in 1855.\

1840 Alabama Census (Conecuh County, although no county is quoted in
Virginia Witherington's research papers) shows the family of John
Witherington (about 39) and Mary Ellis (about 34) and 5 daughters (2 between
5-10 yrs; and 3 between 10-15 years) and 3 sons (all under 5yrs).

The probate of the estate of John Witherington was filed in Calhoun County
May 1855 in Will Book 'A'. John died without a will in April, and the
probate papers were filed by wife, Mary Ellis Witherington. No description
of assets was given. He evidently did not own real estate, as none was
mentioned. Children's names were not given in the probate filing.

Although no grave site has been located, a comment by Virginia Mae
Witherington's research materials indicate that John Witherington is likely
buried at Moody Cemetery in Calhoun County, below Artesian and near Bangs
Slough. The property on which this cemetery is located is owned (1999) by
the T.C. Witherington Estate (Alonzo Dawson & Telitha C. Witherington).
Later King burials at this cemetery have permanent grave markers. John
Witherington's grandson, William R. King (died 1890), wife Catherine
Caroline Davis Harris King (died 1914), and their son, George L. King (died
1911), all have nice stone markers at this Moody Cemetery site.







Notes for Mary Ellis:

According to info from the research materials of Virginia Witherington, Mary
Ellis was born May 14, 1801 in SC, not July 1806 in NC as some other records
have indicated. Virginia gave source information for date & place of birth
for Mary Ellis Witherington as the John Witherington Family bible.

It is thought that Mary Ellis Witherington is also buried at the old Moody
Farmplace Cemetery, located below Artesian in Calhoun County, AR and near
Bangs Slough. No marker is to be found today. The grave of her grandson,
William R. King who died in 1890 is marked by an attractive stone, as are
the graves of Will's wife ,Catherine Carolyn Davis Harris King, who died in
1914, and that of their son, George L. King, who died in 1911.

Note: In May 1999, Carroll & Bill King, and Joe Fred McDonald (descendants
of John & Mary Ellis Witherington) erected a protective fence around this
small and abandoned cemetery (Moody Cemetery). Although there remains today,
only the three King stones mentioned above, it is thought that a number of
other King & Witherington unmarked graves are located there. The farms of
both the King and Witherington families (about 1850-1870) were located very
near the Thomas Moody Farmplace.

Note: Since James died June 1849, it would be interesting to be able to
determine if this land grant, approved after his death, was made a part of
his estate. No real estate was listed on the 1850 appraisement of the

James Witherington moved to Union CO, AR following the 1846 death of his
wife, Mary King Witherington in Conecuh County, AL. Several of the children
of James and Mary Witherington are found living with Jno. Coleman King on
the 1850 Census of Union County, AR. Also living with them was Catherine
Coleman King (age 71), the mother of both Jno. Coleman King & William
Augustus KIng and the wife of James King. Catherine was the daughter of the
Rev. James King of SC & Conecuh County, AL.

James Witherington was killed in a deer hunting accident in Union County, AR
in 1849 and is said to have been buried at Wesley Chapel Cemetery, about 5
miles NE of El Dorado on Hwy. 15.

Family lore states "a silk handkerchief was run through the wound in the
heart to stop the flow of blood".

Witherington, 7 Aug 1849.

Augustus L. Witherington (younger brother of James) and William A. King
(younger brother of John Coleman King) were appointed Administrators of the
Estate of James on 7 Aug 1849. Appraisement of Jame Witherington's Estate,
filed in Union County on 22 Aug 1849, showed a total value of $5,346. No
real estate is listed, and the majority of James's assets at death were
eleven slaves (3 men, 3 boys, 2 women/with child, and one 12 year old girl).

of Henrietta King Witherington on April 23, 1846. She is buried in Conecuh

James Sidney King of Union County, son of John Coleman King, in a 1936
family history interview, told a story of his father, John Coleman King and
Gus Witherington crossing the Mississippi River on rafts and riding
horseback when they came to Arkansas. They passed several plantations in the
rich Mississippi Valley where the owners house, known as the 'big house',
was set far back from the road and a big gate and a lawn were out in front
of the 'big house'. King and Witherington made their headquarters at Norris
Springs in Union County and went out each day with a spade looking for rich
land, but decided to go to Texas where Dallas now is. They later decided to
come back to Union County where the transportation on the Ouachita River was
good and they could get their cotton to market at New Orleans and where the
land was rich."

Goodspeed's History of Southern Arkansas of 1890 (p. 825) indicates that A.
L. Worthington (sp?) was a founder of Champagnolle Lodge # 68, A.F.& A.M.,
located at Union Church, Franklin Township. It was organized at an early day
(about 1850) by William C. Langford (Judge), A. L. Worthington and others.

D.D. Pumphry is at present Worshipful Master (1890).

According to letter dated 8 Jan. 1992 from Wm C. Finch of Crossett, AR, Gus
met Mary Emma in New Orleans while there on business. Mary Emma was teaching
piano for a wealthy New Orleans Brevard family at the time. Spencer's Union
CO Marriages shows A.L. Witherington (35) marriage to Miss Mary E. Finch
(21) on 13 Jan. 1859 @ the residence of Dr. Nance. The 1860 Union County
Census, Pigeon Hill, AR. has family living there.

During the Civil War, Gus and two of his bro-in-laws, Wm S. Finch and Robert
L. Withers, purchased a steamboat for moving freight and passangers on the
Ouachita River. They lived on the West shore of the river near Pigeon Hill
in Union County. Wm S. Finch was married to Rebeca Rogers Terrell. Amelia
Finch met and married Robert L. Withers in New Orleans, better known as
'Captain Bob' of the steamboat 'Morgan Nelson'.

Gus is said to have organized a company for the Confederate Army of men from
New London, Pigeon Hill and Longview in Union and Ashley counties. Gus was
elected Captain, and Finch and Bob Withers were Lt.'s. In 1862 the three,
Gus, Finch & 'Captain Bob' had acquired all of the shares of the 'Morgan
Nelson' as partners. They loaded their company of men on the steamboat and
headed off to New Orleans to enlist. Being 6 foot 6 inches tall, the General
in N.O. agreed to accept the company but told Gus that he could not be
accepted, as he would be the first to be killed because of his height. The
resourceful General (possibly General Lovell, who was in New Orleans until
1862 when N.O. fell to the Union troops) then persuaded Gus, Finch and
Withers (according to family lore) to use the steamboat to run supplies and
munitions for the Confederacy, making them all three Captains* of the
Confederate Army (*unproven). The boat carried flags of both the CSA and the
USA, and the men on board had both Confederate and Union uniforms to aid
them in running the blockades on the rivers. From May 1862 until June 1865
they operated the steamboat for Major Latimer's Quartermasters Corps, Camden
Hqs. They operated the boat on the Ouachita, Mississippi, Red, Black and
Saline Rivers, and were permitted to carry cotton, other products and
passangers on their south bound voyages and to keep those earnings for
themselves. All three ended up 'rich', each with a chest full of Confederate
bills, which were worthless at the end of the war. They took the 'Morgan
Nelson' to New Orleans and sold it in December 1865. Captain Bob Withers
soon after bought another steamboat, the 'Carrie Poole', which he operated
for a number of years on the Saline River near Longview at Cavaness Landing
where he also operated a ferry.

Gus Witherington was murdered at Moro Bay (Bradley County) in 1869, only a
few years after the war ended, and was buried at the cemetery in New London,
Union County. According to newspaper reports, he was shot three times from
behind, once in the head. His killer, James A. Davis, had held a grudge
against Gus for an earlier beating given him by Gus sometime earlier and had
laid in wait for Gus on the day of the killing. He escaped capture, but
surrendered to authorities in Calhoun County in February 1872, almost three
years after shooting Gus Witherington. According to newspaper reports, Davis
was found "not guilty" of the murder. The decision of the jury was no doubt
influenced greatly by witnesses who testified of the terrible beating that
Gus had inflicted on Davis and the threats made by Gus to kill Davis.

Following Gus' death, Mary Emma married William D. Harrison and later moved
to Pine Bluff. She is buried in Pine Bluff with her second husband
(Harrison).

Killed:

We are informed that Mr. Gus Witherington, late of Champagnolle, was, on
Friday 26th ult.,

at Moro Bay killed by a Mr. James Davis.  He was shot three times.  We have
not heard the

particulars of the difficulty.  (taken from the Camden News)

April 6, 1869 (page 3 col 2)

A.L. Witherington, formerly of Champagnolle, but more lately of Mt. Vernon,
Bradley county,

was brutally murdered on the 27th of March, at Moro, Calhoun county, by a
man named James

A. Davis.  He was in conversation at the store door of Bratton & Co., with
Mr. Schaer of Little

Rock, when Davis approaching from behind shot him without warning.  The
first shot passed


through his head, the second through his body, when falling upon the floor
he was shot a thrid

time in the left shoulder.  Mr. Witherington was conveyed to Pigeon Hill,
where he died on the

night of the 29th.  Pigeon Hill Masonic Lodge No. 98, buried Mr.
Witherington with the usual

ceremonies.  We will publish their resolutions next week.  Mr. Witherington
was an old and

respected citizen of Union County.

The governor has offered a reward of $200 for the arrest and conviction of
James Davis, charged

with the murder of A.L. Witherington, at Moro Landing, Calhoun County.

The Warren Eagle says Jas. A. Davis, who shot and killed A.L. Wortherington
(sic), a highly

respected citizen of Bradley county, about three years ago, and made his
escape, created quite

a sensation the other day by reappearing and surrendering himself to the
officers of the law with

a view of standing trial.

The Bradley County Eagle Sat. Jan. 27th, 1872:

The Murderer Now In Jail In This City

Last Tuesday night our town was thrown into a fever of excitement by the
arrival at the Warren House of Mr. James A. Davis.  Charged with murder and
under an escort of armed men.

It appears that about four years ago a difficulty occurred in the village of
Mount Vernon, in this county, between two residents, named A.L.
Wortherington (sic) and James A. Davis; the former being the aggressor.
Davis was beaten in a most shocking manner, his face being battered in a
terrible way;  his eyes nearly put out;  his jaw broken, and his spine
injured beyond recovery.

While being thus outraged and unable to defend himself he said:
"Wortherington (sic), you had better kill me now, while you have a chance,
for if I ever recover, I will kill you!"

At last the difficulty ceased and the parties separated.  Time rolled on and
about a year elapsed, when they met again, in the village of Moro Bay, on
the Ouachita river, about the 28th of March, 1869.  When Davis saw
Wortherington (sic), he said to a bystander:  "Is that Wortherington (sic)?"
And upon receiving an affirmative reply, walked off, got a shot gun, and
deliberately shot his victim dead.

Fearing mob law, James A. Davis took up his abode in Calhoun County where he
remained until the time of his arrest. In the meantime it appeared the Grand
Jury of this county found a true bill against him for murder in the first
degree for which he was arrested. When the officers presented the warrant,
he surrendered cheerfully, and is now closely confined in the county jail.

He seems quite indifferent to his situation and thinks the law will justify
his____deed;  and from what we learn, public sympathy is with him, for
Wortherington (sic) is represented as being very turbulent and quarrelsome
disposition, even to maltreat any person for the least imaginary cause and
threatened the life of Davis several times carrying guns to execute his
threats.  These are represented by the facts in the case and we give them to
the public without comment.

One mention of Mt. Vernon appeared in the Ark Gaz May 17, 1872 [page 1 col
1]

The Pine Bluff Republican of the 9th says:  Col. King White brings us the
intelligence of the destruction, by fire, of the store-house of Mr. Harrison
at Mount Vernon, in Bradley county, a few nights since.  A threat was made
by C.C. Childs that he would burn the building, and the night following this
threat the building was burned.  Childs is now in jail, but under indictment
for murder.  If he perpetrated the deed he will doubtless escape punishment,
as the other crime is first on the slate.

Note: This would have been the Mt. Vernon homeplace of A.L. Witherington
(deceased), as Emma Finch had married William D. Harrison following Gus'
murder.

71765, is Overseer of the New London Cemetery.

Gravestone shows that he died March 27, 1869. Age: 50 Years, 2 Months and 26
Days.

Gravestone indicates that Gus was a Mason.

Bill & Lynn King visited Gus' gravesite in this well maintained cemetery on
June 13, 1999 following the Witherington Family Reunion.

Martha K. Lovett Witherington, first wife of Gus, was buried at Wesley
Chapel Cemetery, Union County.

Directions: Take Hwy 15 east from Hwy 167 at El Dorado toward Moro Bay. The
cemetery is located about 3 miles out on north side of the road, just before
entering Old Union.

Union County Cemetery Book shows that Martha was born Oct. 30, 1827 and died
Oct. 30, 1857. She was the daughter of W.A. & E.W. Betts (?). Buried nearby
at Wesley Cemetery is Dick Witherington, born Jan. 23, 1852 and died Sept.
18, 1857. Date of birth in 1852 would indicate strong possibility of Dick
being the son of A.L. and Martha Witherington.

Thank you so much for including me in your mailing of the latest version of
the continuing saga of Augustus Levan WITHERINGTON! I am delighted. You
mentioned that this is material for a book, or movie, or both. I think you
are writing the book! With that in mind, I have been bold enough to proof
read the copy you sent me. Also, I am seeking additional documentation for
the story.

The Warren newspaper article mentions that Gus was buried with full Masonic
rites. I am not a Mason, but am constructing a database of deaths recorded
by various AR lodges. Sometimes, it produces a pearl, as in the case of your
Gus. Here is the verbatim record -

"Witherington, A.L.  Mt. Vernon UD 27 Mar 1869, Nov 1869."

This translates to the death record of A.L. WITHERINGTON, of the Mt. Vernon
(Bradley Co) lodge.

(The UD apparently signifies that the lodge was as yet unnumbered. A
standard entry would say, "Mt Vernon 218 Mt Vernon," or similar. This would
mean it was the lodge named Mt Vernon, Arkansas Lodge number 218, and
physically located at Mt Vernon) 27 Mar 1869 is the date of his death, and
it was recorded in the Lodge Book dated Nov 1869. Each lodge checked and
updated all its records annually in November, and apparently these records,
or copies, where forwarded to the Grand Lodge in Little Rock. They may have
closed their records in November in order to be sure the annual book was
completed and reached Little Rock before the end of the year. Anyone dying
in Dec 1869 would appear in the Nov 1870 book.

One puzzlement I noticed was that the calculated life span on Gus' tombstone
does not correspond with the birth and death information on the same stone.

I don't mean to be picky. Probably all old university professors are like
this! Will let you know ASAP what other, if any, records I can discover for
you to use as documentation.

The officer in New Orleans was right in rejecting Gus for military service.
He WOULD have been the first one shot because a man that size cannot shrink
and hide. I did the genealogy of a fellow in northwest several years ago for
his great granddaughter, and pointed out to her that his recruiting

officer had effectively murdered the man. He was 6' 5" tall and the
recruiter put him in the CAVALRY!!! A man that size would have to have a
tall horse to keep his feet from dragging the ground, so you've got an 8
foot tall target trying to slip through the woods, or charge across a field.
Sure enough, the fellow was killed in his very first engagement! Thanks for
a heck of a story.

Martha K. Witherington - Born 10-30-1827 - Died 10-30-1857, buried at Wesley
Chapel Cemetery, on Hwy 15, 3 miles NE from Hwy 167, cemetery on North side
of Hwy. 1991 list of cemetery indicated that the stone was broken. The
church is no longer there.

Dick Witherington, son of Martha & Gus, died just 1 month prior to his
mother in 1857, at the age of 5. He is also buried at Wesley Cemetery.

Husband Augustus L. Witherington is buried at New London Cemetery, Union
County, SE of Moro Bay, in the Finch Family Plot. (Mary Emma Finch's
family). New London, AR is located a few miles SE of Wesley Cemetery, toward
Strong, AR.
